Service order and delivery terms

By using the vertaafood service, the user ("User" or "you") accepts these terms of order and delivery and undertakes to comply with them. The user must read these order and delivery terms carefully before using the vertaafood service. You will not use the vertaafood service if you do not accept these terms.
  • Definitions

    “Restaurant” means a restaurant or other partner who has signed a cooperation agreement with vertaafood and offers its products and/or delivery services through the vertaafood service.

    “vertaafood service” means the vertaafood website www.vertaafood.fi.

    “User” means a natural person or legal entity using the vertaafood service.

    ”Order” means a binding order for the product or service to be purchased by the User to the Restaurant through the vertaafood service.

    ”Purchase agreement” means a binding contract between the User and the Restaurant for the purchase of the service.

    vertaafood is a software company from Jyväskylä. vertaafood`s main product is an online food ordering portal. As the operator of the service, vertaafood is responsible for the operation of the vertaafood service and for payments.

  • Description of the vertaafood service

    vertaafood offers a platform that the User can use to buy and order food and delivery services from the Restaurant of their choice.

    By selecting a product or service to be purchased from the Restaurant in the vertaafood service, the User places a binding order for the product or service in question under the terms that are presented to the User in the vertaafood service in connection with the order.

    When the User has sent the order, it is transferred to the Restaurant, which prepares the ordered products and handles the transportation of the products. vertaafood is not responsible for whether the Restaurant fulfills its obligations according to the Order as agreed.

    After receiving the User`s Order, vertaafood forwards the Order information to the Restaurant. Once the Restaurant has accepted the Order, a binding contract for the purchase of the Restaurant`s products and services is created between the Restaurant and the User. vertaafood delivers the order confirmation to the User to the e-mail address provided by the User on behalf of the Restaurant.

    you are able to make guest order for the once or more. we are using your data as name, surname, email address, address and the phone number for using that to inform official organisation as restaurants bookkeper and the case of tax office. you are able to use this account as much you want but we are for every order informing to official organisation as your name and address.
  • Become as a guest to customer
    The customer as a guest are always welcome to be our user. We are saving all your orders coupon in our system and when you become our user you can see your coupon and benifit under your setting. And you can use those benifit for the same restaurant later on.
  • Order confirmation, delivery and delivery time
  • Order confirmation
    After receiving the order, vertaafood sends an order confirmation to the e-mail address provided by the User.
  • Order delivery

    When the user orders delivery for his order through the service, the order is delivered to the address specified by the user in the service. The Restaurant that received the order is responsible for transporting the order.

    If the User has not ordered a delivery service, the products ordered by the User can be picked up from the Restaurant

    vertaafood uses text messages to inform the customer about three things:
    1. Accepting the order and announcing the arrival time
    2. When the order leaves the restaurant, we send a QR code and information about the status of the order on the way. You can use the QR code to acknowledge receipt of the product.
    3. After receiving the product, you will receive a thank you message.
  • Delivery time
    The delivery time of the order is determined according to the delivery times announced by the delivering Restaurant. The estimated delivery time is always indicated when placing the order.
  • Facebook login/registration
    If you have a Facebook profile, you have the option to create a customer account or register on our website using the "Facebook login" button. To identify "Facebook Login", look for the blue button with the Facebook logo and the text "Login with Facebook".
    When you use the "Log in with Facebook" button on our website, you are automatically logged in or registered with your Facebook credentials (if you are a new customer, you will be registered). However, we only receive general and publicly available information from your Facebook profile (such as name, profile picture and email address). Before registering, we send you a notification about data exchange with Facebook, and the extent of the data we receive depends on your personal data protection settings on Facebook.
    We would like to inform you that changes to Facebook`s privacy policy and terms of use may result in the transfer of your profile pictures if they are marked as "public" in your Facebook privacy settings. If you have given permission to publish the necessary information (such as first name, last name and e-mail address) on Facebook, we store and process the information transmitted by Facebook for the purpose of creating a user account.
    Responsibilities
    The Facebook and Instagram social media platforms are operated by Facebook Ireland Ltd., 4 Grand Canal Square, Dublin 2, Ireland.
    We take full responsibility for all interactions that take place on our own platforms. However, we would like to clarify that the controllers of general interactions and interactions outside of our profiles are the administrators of the social media platforms. The only exception to this is usage analysis (page views), where we share joint responsibility with Facebook.
    For your convenience, we have included links to the privacy policies of each social media platform so that you can review the information collected by each operator. As for Facebook, they provide page administrators with statistics and data known as "Page Insights" that help them understand the activities people do on their pages.

  • Delete Account/Delete Data
    You can delete your account and your related data following the steps mentioned below
    1. Log in to your account.
    2. Click on the users icon and select profile.
    3. There you can click on "Delete my Account" button.
    4. You need to approve the deletion from your registered email
    5. Our representative will be review the delete request and your account and data will be removed within 7 working days.
  • Apple login/registration
    We are committed to protecting your privacy and ensuring the security of your personal information. When you choose to log in to our platform with Apple Login, we may ask you to provide your private email address. This information is necessary for the proper functioning of our services and is processed in accordance with this privacy statement. Additionally, as part of our verification process, we ask users to enter their first and last name. You can be sure that we treat this information with the utmost confidence and only use it to confirm your identity. We will not disclose your personal data to third parties without your express consent, unless required by law. By using our Services, you accept and agree to the terms set forth in this Privacy Policy.
  • Payment options
    The user`s payment obligation arises at the time of placing the order. The user can pay with one of the following payment options:
    • Online payment

      Orders are paid in advance in the payment section of your own bank, where the service is automatically transferred from the shopping cart when online payment is selected. After this, the order goes into production. The service has online payment buttons for all the most common banks.

      We currently have an agreement with Paytrail, the service of which includes:

  • Payment upon delivery
    Orders are paid upon delivery.
  • Payment when you pick
    Orders are paid upon pickup from the restaurant. If the User does not pick up the ordered dose or product, an invoice will be sent afterwards to the e-mail address provided by the User.
  • Dosing passport

    The restaurant can use the Annospassi service, through which the customer can earn stamps in his passport for orders accepted by the restaurant. Each restaurant has its own ration passport, as well as control over how stamps are issued. After the amount of stamps set by the restaurant, the customer can earn a reward code, which is delivered to the customer by email and can also be found on the customer`s own page -> portion pass -> restaurant portion pass -> view.

    Stamps for drink orders and transport fees cannot be collected for Annospass

    Paying with a dose pass

    After the customer has received the dose pass code, €8 can be deducted from the final amount of the order on the next order. This is done by entering the unused code "I have an annospassi code" in the column

    The history of the ration card

    After the customer uses her dose pass code, the dose pass coupon shown on her own page is transferred to the customer`s dose pass history.

  • Storage of customer data
    The subscriber`s information is stored in vertaafood Oy`s customer register. For security reasons, each subscriber must register as a user of the service before using the service. By ordering the service, the customer has read and accepted the service`s registration statement. By ordering the service, the customer is registered as a customer of the vertaafood service.
  • Complaints

    7.1 Please note that the vertaafood service can be suspended or permanently or temporarily terminated at any time.

    7.2 suppliers of the vertaafood service undertake to deliver the orders within the stated time and as ordered. The supplier of the order is solely responsible for all errors related to the content of the order or its preparation or otherwise the fulfillment of the order.However, if there is a defect in the delivery or the product, the order confirmation will also include the information of the restaurant that prepares and delivers the order. In matters related to the delivery time and the product, you can contact the delivering restaurant directly to speed up the flow of information. If there are problems with the supplier in the complaint, please submit a written complaint (with a photo proof) to [email protected].

  • Other conditions regarding the use of the vertaafood service

    8.1 Only those over 15 years of age have the right to order products from the vertaafood service.

    8.2 The user does not have the right to transfer the rights or obligations arising from these terms of use in whole or in part

  • Applicable law and dispute resolution
    Finnish law applies to these terms of use and these terms of use are interpreted in accordance with Finnish law. If you are a consumer customer living in the territory of the European Union, you cannot deviate from the mandatory consumer protection legislation of your country of residence, to your detriment. Disputes arising from these terms of use will be resolved in the first instance in the district court of Central Finland. As a Finnish consumer, you can turn to the Consumer Disputes Board in the event of a dispute (instructions can be found at the addresses kuluttajariita.fi and kuluttajaneuvonta.fi)
  • Changes to the terms of use

    10.1 vertaafood can change these terms of use

    10.2 vertaafood publishes the changed terms of use on the service`s website and informs the User about the change in the terms of use in the vertaafood service or by email to the address that the User has added to the vertaafood service. If the User does not accept the changed terms of use, the User must stop using the vertaafood service.
